  1. Introduction
    Welcome to gpmate.com.au (“we”, “our”, “us”, “gpmate”). These Terms and Conditions (“Terms”) govern your access to and use of our website and services, including purchase, access to, and completion of mock examinations (the “Services”) offered for GP trainee preparation for the RACGP AKT and KFP exams. By registering for an account, purchasing any Services, starting or completing any mock exam, or otherwise using the website, you agree to be legally bound by these Terms. If you do not agree to these Terms, do not use the Services.
    These Terms include important legal clauses about intellectual property, data protection, cyber obligations, permitted use, prohibited conduct, and dispute resolution. They should be read together with our Privacy Policy (which explains how we handle personal information) and any other policies posted on the website.
  2. Definitions
    • “Candidate,” “you,” or “user” means the person who registers and/or purchases and uses the Services.
    • “Exam” means any mock AKT or KFP test offered on the site.
    • “Account” means your user account on gpmate.com.au.
    • “Personal information” has the meaning given under the Privacy Act 1988 (Cth) and related guidance.
    • “NDB” means Notifiable Data Breach as defined by the Privacy Act NDB scheme administered by the OAIC.
  3. Services and Scope
    3.1. Service Description. We provide online mock exam simulations intended to replicate the style, timing, and difficulty distribution (average, hard, very difficult) of the RACGP AKT and KFP exams. Exams are sold on a per-attempt basis at the published fee (currently AUD $45).
    3.2. Performance Reports. On completion, candidates receive a summary performance report by email that provides aggregate scoring and domain performance similar to the real exam. No detailed question-by-question explanations or model answers will be provided.
    3.3. Cohort Reports. We may publish anonymised cohort-level performance reports to provide comparative insights. These will not include personally identifying information.
  4. Access, Time Limits and Use Conditions
    4.1. Access Period. Purchased Exams must be completed within 10 days from the time of purchase. After 10 days the Exam access will expire and you will lose the ability to commence or resume that Exam.
    4.2. Commencement. Once you commence an Exam (start answering questions) the Exam purchase is treated as fully consumed. No partial refunds or extensions will be granted once an Exam has begun.
    4.3. Early Completion. Completing an Exam earlier than the 10-day window is treated as full delivery; no credits or refunds are available for early completion.
    4.4. Technical Requirements & Candidate Responsibility. You are responsible for the hardware, internet connection and environment suitable to complete the Exam. We are not responsible for interruptions or failures caused by your equipment, ISP, or local conditions.
  5. Pricing, Payment and Refunds
    5.1. Pricing. Each mock exam attempt is AUD $45 unless otherwise advertised. Prices may be changed for future purchases at our discretion.
    5.2. Payment. Payments are processed through secure third-party payment gateways. We do not store your credit card details.
    5.3. Refund Policy. Refund requests are permitted only within 24 hours of purchase and only if the Exam has not been started. After 24 hours or after you have started the Exam, no refunds will be provided under any circumstances. By purchasing you confirm you accept this strict policy.
  6. Intellectual Property, Restrictions and Prohibitions
    6.1. Ownership. All content on the site — including questions, exam structure, reports, design, graphics, software, and text — is the exclusive intellectual property of gpmate and/or its licensors. Purchase of an Exam grants you a limited, revocable, non-transferable license to access and use that Exam for your personal study only.
    6.2. Prohibited Actions. You must not:
    • Copy, reproduce, store, redistribute, transcribe or otherwise reproduce Exam content, in whole or part.
    • Take screenshots, record, photograph, or otherwise capture Exam screens or materials.
    • Share, publish, sell, or disseminate any Exam materials to others (including posting to social media, forums, or third-party platforms).
    • Use the content for commercial purposes (tutoring, resale, training packages) without express written consent.
    6.3. Consequences. If you breach these provisions we may immediately suspend or terminate your access, cancel your Account, and pursue civil and criminal remedies available to us (including for intellectual property infringement and unauthorised use).
    Note: Copying or disseminating exam materials can amount to criminal or civil offences under Australian laws addressing computer offences and copyright infringement. See Section 14 (Legal Compliance & Enforcement).
  7. Cybersecurity, Data Protection and NDB Obligations
    7.1. Our Security Measures. gpmate maintains reasonable technical and organisational measures to protect personal information against loss, unauthorised access, modification or disclosure. We follow best-practice guidance for small and medium enterprises as set out by the Australian Cyber Security Centre (ACSC) and regulatory guidance on cyber resilience.
    7.2. Your Security Obligations. You must keep your Account credentials secure and not share your login with others. You must notify us immediately if you suspect unauthorised access to your Account.
    7.3. Notifiable Data Breaches (NDB). Where a breach of personal information causes likely serious harm to individuals, gpmate will assess whether the breach is an “eligible data breach” under the Privacy Act’s Notifiable Data Breach scheme and, if required, will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the NDB scheme and guidance. If you suspect a data breach affecting our Services, notify us immediately.
    7.4. Incident Response. In the event of a suspected data breach we will: contain and investigate the incident, assess whether the incident is an NDB, notify the OAIC and affected individuals as required, and take reasonable steps to mitigate harm. We will also cooperate with law enforcement and regulatory authorities where required.
  8. Communications, Marketing and Spam Compliance
    8.1. Transactional Communications. By creating an Account and purchasing an Exam you consent to receiving transactional communications (purchase confirmations, performance reports, account notices) from us at the email address you provide.
    8.2. Marketing Communications. We will only send marketing communications where you have consented to receive them. You may opt out of marketing emails at any time via the unsubscribe link.
    8.3. Spam Law Compliance. gpmate complies with the Spam Act 2003 and ACMA guidance when sending commercial electronic messages; we will not send unsolicited commercial messages without appropriate consent and will always include an easy unsubscribe method. Failure by other parties to comply with these obligations does not relieve you of the law; if you send commercial messages on behalf of others you must ensure compliance with Australian law.
  9. Lawful Access and Assistance to Authorities
    9.1. Law Enforcement Requests. We may be required by law to provide data to law enforcement or national security agencies under Australian statutes (including but not limited to the Telecommunications (Interception and Access) Act 1979 and criminal laws). Requests will be dealt with in accordance with applicable legal processes.
    9.2. Disclosure of Data. Where required by court order, subpoena or lawful warrant, we may disclose Account or Exam data to relevant authorities. We will notify you of such requests unless prohibited by law.
  10. Acceptable Use and Candidate Conduct
    10.1. Testing Integrity. You agree to complete Exams honestly and without assistance, to avoid collusion, and not to allow others to complete Exams for you. Use of external materials, communicating with others during an exam, or other forms of cheating are prohibited.
    10.2. Account Sharing. Account sharing is prohibited. If multiple users are found to be accessing an Account, we may suspend or terminate the Account with no refund.
    10.3. Remedies for Cheating or Misuse. Where cheating is suspected we may withhold, cancel or adjust Exam results, suspend Accounts, and take legal action where appropriate.
  11. Copyright and Third-Party Content
    11.1. Copyright. All content is protected by copyright law (including the Copyright Act 1968 (Cth)). You may not reproduce or use content beyond the limited license granted. If you require permission to reuse content for legitimate academic or commercial needs, contact us to request licensing terms.
    11.2. Third-party Links. Our website may contain links to third-party sites. We are not responsible for their content or privacy practices; links are provided for convenience only.
  12. Warranties, Disclaimers and Limitation of Liability
    12.1. No Warranty. The Services are provided “as is” and “as available.” While we aim for accuracy and currency, we do not warrant that Exams are error-free or reflect the exact content of any official examination.
    12.2. No Guarantee of Outcome. Use of the mock Exams does not guarantee success on any real exam.
    12.3. Limitation of Liability. To the fullest extent permitted by law, gpmate’s aggregate liability arising from or related to these Terms, your Account or the Services will not exceed the total fees paid by you to gpmate in the 12 months preceding the claim. We are not liable for indirect, incidental, special or consequential losses (including lost income, lost opportunity or reputational loss).
    12.4. Statutory Rights. Nothing in these Terms is intended to remove or restrict rights you may have under Australian consumer law where those rights cannot be excluded.
  13. Indemnity
    You agree to indemnify and hold gpmate and its officers, employees and contractors harmless from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of content, abusive conduct or unlawful activity.
  14. Legal Compliance & Enforcement
    14.1. Cybercrime & Computer Offences. Unauthorised access, modification, interference or impairment of computer systems or data is a criminal offence under Australian law (including the Criminal Code and related statutes). We will report unlawful activity to the relevant authorities and cooperate with law enforcement where necessary.
    14.2. Copyright Infringement. Unauthorised copying or distribution of content may result in civil liability and criminal penalties. Where we identify potential infringement we may pursue civil remedies, have content removed, and refer matters for criminal investigation.
  15. Account Suspension, Termination and Remediation
    15.1. Suspension. We may suspend or restrict access to an Account (temporarily or permanently) where: we detect suspicious or fraudulent activity, we suspect violation of these Terms, or where required by law.
    15.2. Termination. We may terminate Accounts for material breach (including cheating or distribution of content) without refund.
    15.3. Remediation. At our discretion, we may offer remedial measures (replacement Exam attempt, reissue of summary report) for technical failures caused by us. Our liability in such events is limited to providing a replacement attempt or refund within our stated refund policy.
  16. Changes to the Terms
    We may change these Terms from time to time. Revised Terms will be posted on the site with an updated “last updated” date. Changes will apply to new purchases made after the effective date; where changes materially affect existing rights we will use reasonable efforts to notify affected users by email.
  17. Transit, Force Majeure and Availability
    We strive for high availability but do not warrant uninterrupted access. We are not liable for unavailability caused by factors beyond our reasonable control (force majeure, infrastructure outages, third-party service provider failures, cyber-attacks, natural disaster).
  18. Dispute Resolution, Governing Law and Jurisdiction
    18.1. Informal Resolution. If a dispute arises, please contact us first at the contact email; we will attempt to resolve disputes amicably.
    18.2. Governing Law. These Terms are governed by the laws of New South Wales, Australia.
    18.3. Jurisdiction. Subject to mandatory consumer law, the parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
  19. Severability and Entire Agreement
    If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in force. These Terms, together with our Privacy Policy and any purchase confirmations, represent the entire agreement between you and gpmate in relation to the Services.

    • If you receive any suspicious email purporting to be from gpmate, contact us; do not click links or provide credentials.
  23. Acknowledgement
    By purchasing or using our Services you confirm that you have read, understood and agreed to these Terms and our Privacy Policy and accept the legal obligations and restrictions contained herein.
